1. Agreement to Terms

By accessing or using Deckflo ("the Service"), operated by Deckflo ("we," "us," or "our"), located in Mumbai, India, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including free-tier users, paid subscribers, and team account holders.

2. Description of Service

Deckflo is an AI-powered content creation platform that enables users to create presentations, flowcharts, infographics, and dashboards using artificial intelligence. The Service includes:

• AI-powered presentation, flowchart, infographic, and dashboard generation
• Rich editing tools for customizing generated content
• Template libraries for quick starting points
• Real-time collaboration features
• Export functionality in multiple formats (PPTX, PDF, PNG, SVG)
• Publishing and sharing capabilities
• Image search and integration via third-party APIs

3. User Accounts

To use certain features of the Service, you must register for an account. When you create an account, you agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate and complete
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

4. Subscription Plans and Payments

Deckflo offers the following subscription tiers:

• Free Plan: Limited AI generation capabilities with basic features
• Pro Plan ($12/month): Unlimited AI generation, premium templates, branding removal, and collaboration features
• Team Plan ($39/month): Includes 5 Pro licenses, shared workspace, admin dashboard, and priority support

Payments are processed through our third-party payment providers (LemonSqueezy and PayPal). By subscribing to a paid plan, you authorize us to charge your chosen payment method on a recurring monthly basis until you cancel. Prices are subject to change with 30 days' prior notice.

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of the current billing period.

5. AI-Generated Content

The Service uses artificial intelligence (powered by third-party AI providers including OpenAI) to generate content. You acknowledge and agree that:

• AI-generated content may not always be accurate, complete, or free from errors
• You are solely responsible for reviewing, editing, and verifying all AI-generated content before use
• We do not guarantee the originality or uniqueness of AI-generated content
• AI-generated content should not be relied upon for legal, medical, financial, or other professional advice
• We reserve the right to modify, update, or change the AI models and providers used by the Service

6. Intellectual Property

Your Content: You retain ownership of all content you create using the Service, including presentations, flowcharts, infographics, and dashboards. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you.

Our Platform: The Service, including its design, code, features, logos, and branding, is owned by Deckflo and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

Templates: Templates provided by the Service are licensed for use within the platform. Free-tier templates may include Deckflo branding. Pro and Team subscribers may remove branding from their content.

7. Acceptable Use

You agree not to use the Service to:

• Generate, store, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violate any applicable local, national, or international law or regulation
• Infringe upon the intellectual property rights of others
• Transmit malware, viruses, or any other malicious code
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service for any fraudulent or deceptive purpose
• Resell, redistribute, or sublicense access to the Service without authorization
• Use automated tools (bots, scrapers) to access the Service in a manner that exceeds reasonable use
• Generate content intended to mislead, deceive, or spread misinformation

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice.

8. Third-Party Services

The Service integrates with third-party services including but not limited to:

• OpenAI: For AI content generation
• Unsplash: For image search and integration
• Supabase: For authentication and data storage
• LemonSqueezy / PayPal: For payment processing

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

9. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal data. By using the Service, you consent to the collection and use of data as described in our Privacy Policy.

10. Service Availability and Modifications

We strive to maintain the Service's availability but do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service at any time
• Perform maintenance that may temporarily affect availability
• Update features, pricing, or functionality with reasonable notice
• Limit or restrict access to certain features based on subscription tier

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DECKFLO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Indemnification

You agree to indemnify and hold harmless Deckflo, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of a third party.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account data after a reasonable retention period
• Any outstanding payment obligations remain enforceable
• Provisions that by their nature should survive termination will remain in effect

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

Before pursuing formal legal proceedings, you agree to first attempt to resolve any dispute through good-faith negotiation by contacting us directly.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

For material changes, we will make reasonable efforts to notify you via email or through the Service.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
